A judge has ruled against a mum breastfeeding her baby.

All because she got a tattoo four weeks ago.

Judge Matthew Myers has ruled that a Newcastle woman is not allowed to breastfeed her 11-month-old baby, following her decision to get a tattoo four weeks previously.

Myers believed the decision to get a tattoo put the baby at risk of contracting hepatitis and/or HIV. This is despite the mother receiving test results that showed she did not have either of these diseases.

The Family Court will hear an urgent appeal tomorrow against Myer's injunction. The issue of the tattoo was initially raised by the baby's father during a fierce custody dispute. The Australian reports that the judge relied on material published by the Australian Breastfeeding Associa­tion in making his decision.

According to the ABA, "Hepatitis B or C and HIV are serious viruses which can be transmitted if equipment for tattooing is not cleaned and sterilised properly between users. The main cause for concern out of these viruses for a breastfeeding mother is HIV because it is known to be able to be transmitted via breastmilk."

The ABA further explains that while the risk of contracting a disease from a tattoo is low, it is a health risk which must be carefully considered.

Further to this, ABA spokeswoman Nicole Bridges told The Australian that the decision was “extremely concerning.” She worried that this may stop other mums from breastfeeding their newborns.

“There’s no evidence that the mother has contracted HIV or any other virus so there’s no ­reason to think there’s a risk to her baby,” she said.
