The babysitter was spared jail time.

A father has defended a babysitter who sexually abused his 11-year old son saying his son saw it as “a notch on his belt.”
The comments, made in a statement to a judge have shocked child protection advocates.
The babysitter, 20-year old Jade Hatt was found guilty and jailed for six months for the abuse of the young boy, but her sentence was suspended for two years and she will not serve any jail time.
Hatt from Swindon, Wiltshire, in the UK was babysitting the boy last November when he was home from school sick.
Prosecutor Hannah Squire said “The defendant was friends with the boy’s father, with whom she had had a brief sexual relationship.”
“He would ask her to babysit; she had babysat his 11-year-old son on six or seven occasions. On one of those occasions this offence took place.”
In describing the rape of the young boy the Prosecutor said it was around 11.30am when the defendant “sat on top of the boy who was lying down.”
“Jade Hatt sat on top of him, sat astride him, took off her clothes and removed his.” Hannah Squire told the court.
“In his words she started bouncing on his private parts. Sexual intercourse took place. According to him it was fairly brief: about 45 seconds. She told him she enjoyed it, he said he had not as it was wrong.”
The boy’s father then noticed he had a “love bite on his neck” and found text messages from Ms Hatt revealing what had taken place.

I do think gender dynamics are relevant and should be taken into consideration- just as the age is an issue because of the power an older person holds over a younger person- gender is also relevant because of power relations between males and females (especially when it comes to sex). Having said that, an 11 year old???!!!!! And what is it saying about the father if he was willing to sleep with a 20 year old who was very immature for her age (to the point that it was 'okay' for her to be having sex with an 11 year old!)?
No, gender dynamics have absolutely nothing to do with a 20 year old raping a 11 year old, no matter what the genders are.
I'm quite happy to argue things like Andrea Dworkins theory that 'All sex is rape' if you like, but that can't have any baring on this case.
The trouble here is that the judge considered gender dynamics relevant enough to disregard the feelings of the 11 year old victim, who knew what happened to him was wrong.
Instead the judge considered gender dynamics relevant enough to believe the picture the defence created of him being a sex-crazed male, instead of seeing him as a vulnerable child who was betrayed by the multiple care providers who sexualised him.
This case is a prime example of why gender dynamics should not be relevant in sentencing for sex crimes.
I probably didn't articulate very well, I completely agree gender should not be an issue here- the boy knew it was wrong and he was 11. Its disgusting and disturbing, and its beyond me how the judge came to that conclusion. I actually meant in general, because of the ways that masculinity and femininity are portrayed in our society, I do believe gender is relevant when discussing these types of issues.
No thanks (re debate). I personally believe its pretty impossible to ignore the impact gender has on situations like this. I have no doubt this woman raped that boy. But I believe there are different dynamics than if the perp had been a man and the victim an 11 yr old girl. Not saying either are more 'wrong' than the other- just that they are different, in part because of the power relations between males and females (and also because of the way masculinity is performed in our society etc.)
