I grieve for you and your child! Having lost my daughter I know there is NO Pain like it. It has been 19 yrs. since her death but sometimes it was yesterday! I am glad I'm not the judge. My daughter's death was caused by 3 people, I feel. But I don't know what to think about this 10 yr old, First, I believe the daycare has first responsibility! Your son should never have been left like he was, alone with an unsupervised child. Did the girl know what she was doing? I would not think she was trying to kill your child. Though She certainly has violent tendencies! maybe, maybe ....see that's the problem you'll never really know why she did those things because she probably doesn't know herself. But, even punishing her will not bring back your precious baby. I never really went thru a very long anger phase which is one of the stages of grief Your supposed to feel all these feelings, anger, sadness, guilt, etc. But in the end Kelly was gone and nothing could bring her back. I'm so sorry!
